Immigration Services Program
Supporting the Latin American Association has a meaningful impact on Latinos in metro Atlanta. Under current U.S. law, immigrants in removal proceedings have no right to appointed counsel, because the proceedings are considered civil rather than criminal in nature. An immigrant without an attorney is far less likely to have their applications granted. Without representation in Immigration Court, immigrants must by themselves face a government lawyer and the immigration judge. Additionally, they must be able to plead to the allegations and charges set out in the charging document, file appropriate forms and documents in English, and try to understand the nature of the proceedings and the consequences of the immigration judge’s order.
The Immigration Services Removal Defense program promotes public understanding of the law. Immigration law can be very difficult to understand, particularly for the populations we serve who have limited English proficiency and often very limited education, even in their home countries. Both through one-on-one legal consultations and through public forums, this funding would enable us to educate individuals on their rights and opportunities.
The Latin American Association’s Removal Defense program ensures that clients in Immigration Court receive fair treatment and have access to well-researched, well-documented applications for relief. Our attorneys explain the legal proceedings to the immigrant clients, educate them concerning all available legal options, and accompany and represent them in court. Our program enables all individuals living in this country to have access to the representation that could allow them to live freely in this country and to provide economically for their families.
