2014 Americans With Disabilities Act Update - 1 CLE hour

This program will provide you with a wide-ranging discussion of case law and regulatory developments under the Americans with Disabilities Act.  The program will discuss significant new appellate decisions interpreting “disability” and the EEOC’s new guidance on pregnancy and related impairments. Developments related to “reasonable accommodation,” “essential functions” of jobs, and qualification standards will also be covered.  The program will cover the spread of employer wellness programs and potential violations of the ADA.  This program will provide you with a practical guide to significant case law and regulatory developments under the ADA, including those related to the core terms “disability,” “reasonable accommodation,” and “essential functions.”  

Review of significant new case law on the definition of “disability” 
“Reasonable accommodation” developments – interactive process, tele-work, leave, reassignment
Recent EEOC guidance on pregnancy discrimination and related impairments
Disability-related inquiries and medical examinations 
Qualification standards, disparate impact and the ADA

Christopher Kuczynski
is Assistant Legal Counsel and Director of the Americans With Disabilities Act Policy Division at the United States Equal Employment Opportunity Commission in Washington, D.C.  He supervises the development of policy guidance interpreting Title I of the ADA and advises EEOC’s field offices, Office of General Counsel, and chair and commissioners on ADA investigations and litigation.  Earlier in his career, he served as Associate Director for the White House Domestic Policy Council and as a trial attorney in the Civil Rights Division of the United States Department of Justice. Mr. Kuczynski received his B.A. from Villanova University, his J.D. from Temple Law School, and his L.L.M. from the Yale Law School.

Nancy Abell is a partner in the Los Angeles office of Paul Hastings LLP, where she formerly chaired the firm’s global employment law department.  She works with private and public employers in all aspects of employment law, including wrongful discharge, discrimination, sexual harassment, whistle blower, and labor-management litigation.  She is a Fellow of the College of Labor and Employment Lawyers and is named in "The Best Lawyers in America."  She has served as chair of the Board of Governors of the Institute for Corporate Counsel and co-chair of the Trial Advocacy Subcommittee of the ABA Labor and Employment Law Section Committee on Employee Rights and Responsibilities.
