Adversary Proceeding & Reaffirmation Project Training

The Bankruptcy Section of the Atlanta Bar Association operates a pro bono program that matches volunteer attorneys with qualified litigants in bankruptcy adversary proceedings.  The program serves both plaintiffs and defendants, who are parties to adversary proceedings pending before the U.S. Bankruptcy Court for the Northern District of Georgia.  The basic mechanics of the program are straightforward.  The Bankruptcy Judges of the Northern District identify pro se parties in adversary proceedings who would likely benefit from pro bono representation.  Those parties are referred to the program's administrator who in turn refers them to a volunteer attorney. Notably, participation in the program can provide opportunities for younger lawyers to gain experience managing clients, managing cases, preparing for trial and trying cases.


Although participation in the program does not require extensive knowledge of bankruptcy law, volunteers who do not regularly represent litigants in bankruptcy adversary proceedings are encouraged to attend a training session offered by the Section. Training sessions include an overview of bankruptcy court jurisdiction, rules of procedure applicable in adversary proceedings and substantive issues typically arising in adversary proceedings in individual bankruptcy cases, including determining the dischargeability of particular debts and violations of the automatic stay and discharge injunction.



The Reaffirmation Project provides free legal counsel to unrepresented debtors seeking to enter into reaffirmation agreements. The goal of this project is to enable pro se consumer debtors to make informed decisions about reaffirmation of debt. Given that the Northern District of Georgia is the third highest consumer debtor filing venue in the United States, this is a much-needed legal service. One of the fundamental goals of the Bankruptcy Code is to provide a financial fresh start to honest but unfortunate debtors. Pro se debtors will not be afforded such relief without the availability of counsel to ensure that all people have effective access to legal assistance. The Reaffirmation Project training session will teach interested lawyers how to provide that assistance.
