On June 25, 2019, the Bankruptcy Section hosted a Summer Associate Day at the U.S. Bankruptcy Court for the Northern District of Georgia. The event was very well attended with over 30 summer associates from local law firms participating. The summer associates were provided with the opportunity to observe an argument before the Honorable Jeffrey W. Cavender and hear remarks from the Honorable Paul W. Bonapfel, the Honorable Jeffrey W. Cavender, the Honorable Lisa Ritchey Craig, and the Honorable Sage M. Sigler. The summer associates were also invited to tour the participating judges’ chambers and courtrooms. 

The Summer Associate Day at the Bankruptcy Court was followed by a Summer Social at No Mas Cantina. The Summer Social was  also attended by over 30 section members, including a number of bankruptcy judges. During the Summer Social, summer associates were able to meet with experienced practitioners and learn more about the Atlanta bankruptcy bar over light appetizers and cocktails. 

Section Breakfast
Registration is now open for the next Bankruptcy Section Breakfast, which will take place on Thursday, September 26, 2019, from 7:30 a.m. to 9:00 a.m. The event will be held at the offices of Arnall Golden Gregory LLP. The breakfast will include a presentation on The Automatic Stay and the Discharge Injunction following Taggart v. Lorenzen. Matt Berry (Berry & Associates), and Vanessa Leo, (Shapiro Pendergast & Hasty LLP), will present; the panel will be moderated by Alexandra "CC" Schnapp (U.S Bankruptcy Court, Law Clerk to Chief Bankruptcy Judge Wendy L. Hagenau). We hope you will join us.

Please save the date for our Fall Social on October 17, 2019! The annual gathering will be held at Sweetwater Brewing. Mark your calendar to enjoy beer and BBQ at Atlanta’s favorite brewery.

On May 16, 2019, the Bankruptcy Section hosted its annual David W. Pollard Award Luncheon and Spring CLE Program at Ansley Golf Club honoring Alison Elko Franklin (Dentons US LLP). The event was well attended by over eighty members of the Bankruptcy Section and began with a three-part CLE presented by distinguished speakers on the topics of Judgement “How To’s,” the Role of In-House Counsel, and Alternative Dispute Resolution.

 

Michael Bargar, Bankruptcy Section Member at Large (Arnall Golden Gregory LLP), Leon Jones (Jones & Walden, LLC), and the Honorable Lisa Ritchey Craig, U.S. Bankruptcy Court, Northern District of Georgia presented Judgment “How To’s” and discussed how to revive judgments, avoid judicial liens, and handle choses in action. The Role of In-House Counsel panel was moderated by Melissa J. Davey, Bankruptcy Section Chair (Standing Chapter 13 Trustee), and included Yendelela Neely Holston (Kilpatrick Townsend & Stockton LLP), Kevin Hembree, (Georgia-Pacific LLC), and Jonathan C. Lippert (Porsche Cars North America, Inc./Porsche Financial Services, Inc.). The Alternative Dispute Resolution presentation was moderated by Taylor Mansell, Bankruptcy Section Member at Large (Shapiro, Pendergast and Hasty LLP) and the panelists included the Honorable Jeffrey W. Cavender, U.S. Bankruptcy Court, Northern District of Georgia and C. Edward Dobbs (Parker Hudson Rainer & Dobbs LLP).

 

The CLE was followed by the David W. Pollard Award Luncheon. This year the David W. Pollard Achievement Award was presented to Alison Elko Franklin (Dentons US LLP).  Alison Elko Franklin is a past Chair of the Bankruptcy Section and has been integral to the Bankruptcy Section’s success and expanding the volunteer opportunities for our members while on the Board. Under her leadership, the Bankruptcy Section received three awards from the Atlanta Bar Association: the Community Service Award, the Pro Bono Award, and the Small Section of the Year Award. 

 

On May 8, 2019, members of the Bankruptcy Section Board also participated in a volunteer event at Agape Youth & Family Center where they served dinner to school-age children from under-served families.

The Atlanta Lawyer Bankruptcy Update: April/May 2019

The Bankruptcy Section concluded another successful year of Credit Abuse Resistance Education (CARE) presentations at eleven high schools across the Atlanta Metro Area. This program allows experienced members of the Bankruptcy Section to present financial literacy information to high school students with the goal to help students better understand the responsible use of credit. This year, over thirty five members of the Bankruptcy Section and seven judges from the United States Bankruptcy Court for the Northern District of Georgia volunteered as presenters for the CARE presentations.


On March 10, 2019, the Bankruptcy Section also participated in the Pro Bono March Madness CLE event with a program on Advocacy in Adversary Proceeding presented by Gregory M. Taube (Nelson Mullins Reilly & Scarborough, LLP). The event was held at the State Bar of Georgia headquarters and included training for one of the Bankruptcy Section’s pro bono initiatives (the Adversary Proceeding Project). The Adversary Proceeding Project matches up volunteer attorneys with qualified litigants in bankruptcy adversary proceedings. The program serves both plaintiffs and defendants, who are parties to adversary proceedings pending before the U.S. Bankruptcy Court for the Northern District of Georgia. The Atlanta Lawyer Bankruptcy Update: February/March 2019

Georgia State University College of Law On February 8, 2019, the Bankruptcy Section presented its Annual Bankruptcy and Commercial Law Year in Review program at the Capital City Club. Over seventy section members attended the program and enjoyed the opportunity to hear from the distinguished panelists on the latest bankruptcy and commercial law case developments from the last year. The morning session focused on recent developments in bankruptcy law and included the Honorable Paul W. Bonapfel, U.S. Bankruptcy Court, Northern District of Georgia, and the Honorable Mary Grace Diehl (Ret.), U.S. Bankruptcy Court, Northern District of Georgia. Additional panelists for the morning session were Harris Winsberg (Troutman Sanders LLP) and Beth Anne Harrill, law clerk for the Honorable Paul W. Bonapfel, U.S. Bankruptcy Court, Northern District of Georgia. The afternoon session focused on commercial law developments and was presented by C. Edward Dobbs (Parker, Hudson, Rainer & Dobbs LLP) and Alfred S. Lurey (Kilpatrick Townsend LLP).


The Bankruptcy Section also hosted its first breakfast of the year on Thursday, January 17, 2019. Nathan Juster, an attorney with the Home Defense Program of Atlanta Legal Aid Society, Inc., presented on home loss mitigation programs. The event was well attended by twenty-five attendees, including several judges, who gathered at the offices of Alston & Bird LLP in Midtown Atlanta. It was a highly informative and engaging program that ended with Mr. Juster fielding several questions from the attentive audience.

The Atlanta Lawyer Bankruptcy Update June/July 2018

On May 17, 2018, the Bankruptcy Section hosted its annual David W. Pollard Award & Spring CLE Program.  The event was held at the Ansley Golf Club.  Each year at this program, the Board of the Bankruptcy Section presents the David W. Pollard Achievement Award to "a person who is a member of the Atlanta Bar who best exemplifies the highest standards of professionalism and ethics in the bankruptcy practice."  The award has become a life-time achievement award.  We were pleased to present the 2018 David W. Pollard Achievement Award to Jeffrey W. Kelley of Troutman Sanders LLP.  

The event began with a CLE program presented by Sean Carter.  In his presentation, Carter highlighted and discussed ethical challenges and issues with an engaging approach, interspersing a bit of humor to keep the audience involved and entertained.  

The CLE program was followed by a luncheon honoring Jeffrey W. Kelley.  During the luncheon, the outgoing Officers and Board members of the Section for the 2017-2018, including the outgoing Chair, the Honorable Jeffery Cavender, were recognized for their contributions to the Section.   

The Officers and Directors of the Board for 2018-2019 include:  Vania S. Allen (Chair), Melissa Davey (Chair Elect), Bruce Walker (Secretary), Gregory Taube (Treasurer), Jeffery Cavender (Immediate Past Chair), B.
